FinCliq Inc. Terms & Conditions

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING THE FINCLIQ WEBSITE OR USING THE FINCLIQ PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS, OUR PRIVACY POLICY, E-SIGN CONSENT AGREEMENT, AND ANY OTHER AGREEMENTS OR POLICIES REFERENCED HEREIN. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM OR ANY SERVICES.

1. OVERVIEW

These Terms of Service ("Agreement") form a legal agreement between you ("you," "your") and FinCliq Inc., including its subsidiaries and affiliates, such as FinCliq Loan Services LLC ("FinCliq," "we," "us," or "our").

This Agreement governs your use of:

  • The FinCliq website and mobile app (collectively, the "Platform")
  • Installment payment services offered by FinCliq
  • Merchant cash advances provided to participating businesses
  • Any other tools, features, or services provided by FinCliq (collectively, the "Services")

2. ELIGIBILITY

You must:

  • Be at least 18 years old
  • Provide truthful and accurate information

Some features may not be available in all jurisdictions. We reserve the right to decline or restrict your access.

3. DESCRIPTION OF SERVICES

A. Payment Plans (Consumers):

FinCliq provides qualified consumers with interest-free installment plans to pay for purchases at participating merchants.

Key features:

  • No interest, only applicable platform/flex fee
  • Down payment (typically 30%) required at checkout
  • Fixed repayment schedule (e.g., bi-weekly)
  • Repayments via linked bank account or debit card
  • Potential rewards in the form of Empowerment Credits

B. Merchant Advances

FinCliq Loan Services LLC may provide sales-based financing (merchant cash advances) to participating merchants, repaid as a percentage of sales made through the FinCliq platform.


    4. ACCOUNT AND SECURITY

    You are responsible for:

    • Maintaining accurate account information
    • Safeguarding login credentials
    • Promptly reporting unauthorized access

    We are not liable for losses resulting from unauthorized use unless caused by our gross negligence.


    5. DATA COLLECTION & USE

    By using FinCliq, you authorize us and our third-party partners to:

    • Access your bank account data (balances, deposits, overdrafts)
    • Retrieve your alternative credit data from Consulytica or similar services
    • Use your data to evaluate your eligibility for payment plans
    • Retain financial and transactional information securely

    You grant FinCliq and its providers a limited power of attorney to access and use your data solely for these purposes. Your data is stored securely using industry-standard encryption protocols and is processed per our Privacy Policy.


    6. WEALTH CREDITS

    Upon successful repayment of eligible plans, you may earn Wealth Credits, a portion of your plan total credited toward financial education or investment tools.

    • Credit amounts vary and are not guaranteed
    • Credits have no cash value and can only be used with partnered firms.
    • Eligibility may be revoked for missed payments


    7. ACCOUNT AND PAYMENT PLAN DISCLOSURE

    When you use FinCliq to make a purchase, you will be presented with a payment plan that includes the following terms:

    A dynamic fee based on the requested amount and plan type, included in installment payments.

    The final amount you will pay under the selected plan
    Interest or APR
    Always 0%
    Missed Payment Fee or Late Fee
    $8
    Late fees are assessed only once per missed payment and do not compound.
    Early Payoff
    Allowed at any time
    Returned Payment or Insufficient Funds Fee
    $25


      8. Delinquent Accounts, Default, and Collections

      If you fail to make a scheduled payment under a payment plan, subscription, Savings Circle contribution, or other FinCliq service, your account may be considered delinquent or in default.

      While FinCliq does not charge interest, continued nonpayment may result in account suspension, loss of eligibility for future services, forfeiture of rewards or credits, and referral of the outstanding balance to a third-party collection agency or recovery partner.

      By using the Services, you authorize FinCliq to share necessary personal, account, and payment information with such third parties for the purpose of account servicing and collections, as permitted by applicable law.

      Collection efforts will be conducted in accordance with applicable federal and state laws. Any communications from third-party collection agencies will be governed by their own legal obligations and disclosures.

      Late fees may be assessed prior to referral to a third-party collection agency, as disclosed in your payment plan terms.


      9. Buyer Protection Policy

      FinCliq is committed to protecting consumers in cases where merchants fail to deliver goods or services as promised. If your order does not arrive, is materially different from what was advertised, or a service is not completed, you may be eligible for Buyer Protection.

      • How it works: You must notify FinCliq within 30 days of the scheduled delivery or service date. We may require supporting evidence such as order confirmations, receipts, or communications with the merchant.
      • Investigation: FinCliq will review the claim, contact the merchant, and make a determination.
      • Outcome: If your claim is approved, FinCliq may reimburse you or apply a credit to your payment plan balance. Refunds are net of applicable fees, and you remain responsible for any outstanding installment balance not covered by the refund.
      • Exclusions: Buyer Protection does not cover buyer’s remorse, disputes about quality outside the merchant’s stated description, or prohibited category purchases.

        This policy supplements, but does not replace, your legal rights under consumer protection laws.


      10. THIRD-PARTY SERVICES

      We use third-party providers for:

      • Bank account access (e.g., Plaid or similar)
      • Credit data (e.g., Consulytica)
      • Payment processing

      You authorize us and these providers to access, transmit, store, and process your data to facilitate the Services. We are not responsible for their actions.


      11. ELECTRONICS COMMUNICATIONS AND E-SIGN CONSENT

      By using FinCliq’s Services, you consent to receive all agreements, notices, disclosures, and other communications electronically. This includes, but is not limited to, your payment plan terms, consent to debit your bank account, privacy policy updates, and other legally required disclosures.

      You agree that electronic signatures and records shall have the same legal effect as physical signatures and documents.

      You may request paper copies at no cost by contacting us at info@fincliq.com. You may withdraw your consent at any time, though doing so may result in loss of access to certain features or services.

      To access and retain electronic records, you will need to:

      • A device with internet access
      • A current web browser
      • The ability to download or print documents


      12. DISCLAIMERS AND LIMITATION OF LIABILITY

      No Warranties: FinCliq provides the Platform and Services "as is." We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

      Limitation of Liability: FinCliq is not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our maximum liability to you is limited to the fees paid by you for the Services in the six months preceding the claim.


      13. TERMINATION

      You may close your account at any time by contacting us. We may suspend or terminate your account if:

      • You breach this Agreement
      • We suspect fraud or unauthorized activity
      • Required by law or regulation

      You remain responsible for any outstanding amounts.


      14. DISPUTE RESOLUTION

      Arbitration Agreement: All disputes must be resolved through binding arbitration under the American Arbitration Association's Consumer Arbitration Rules. You waive the right to a jury trial or class action.

      Limitation Opt-Out: You may opt out of arbitration by sending a written notice within 30 days of first using the Services to: FinCliq Legal Dept., 2024 Old Manchester Street Richmond VA 23225.


      15. GOVERNING LAW

      These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

      17. UPDATES TO THIS AGREEMENT

      We may update this Agreement at any time. Material changes will be posted on the Platform. Continued use of the Services constitutes acceptance of the revised terms.

      FinCliq is not a lender. All installment plans are interest-free and provided in conjunction with merchant cash advances to participating businesses. All rights reserved.


      18. AUTOMATIC PAYMENTS AND AUTOPAY AUTHORIZATION

      By enrolling in a FinCliq payment plan, subscription, Savings Circle, or other service that supports automatic payments (“Autopay”), you authorize FinCliq and its payment processing partners to initiate recurring electronic debits from your linked payment method (bank account or debit card) for amounts owed under your selected plan or service.

      Autopay Terms:

      • Payments will be debited on the scheduled dates disclosed at checkout or enrollment.
      • Payment amounts may vary based on your selected plan, fees, or applicable adjustments.
      • Autopay will continue until your obligation is satisfied or your authorization is revoked.
      • If a payment fails, we may retry the debit and assess a returned payment or insufficient funds fee as disclosed.
      • You may revoke Autopay authorization by updating your account settings or contacting FinCliq support; however, revocation may result in loss of access to certain features or services.

      You agree to maintain valid payment information at all times. FinCliq is not responsible for failed payments due to expired, closed, or insufficient accounts.


      19. FINCLIQ BALANCE (STORED VALUE WALLET)

      FinCliq may offer a stored-value balance feature (“FinCliq Balance”) that allows users to hold non-cash credits for use within the FinCliq platform.

      Important Disclosures:

      • FinCliq Balance is not a bank account.
      • FinCliq Balance is not FDIC insured.
      • Funds held in FinCliq Balance are not withdrawable or redeemable for cash.
      • FinCliq Balance may only be used for purchases with FinCliq-partnered merchants, gift cards, or other approved platform services.
      • No interest or earnings accrue on FinCliq Balance.


      FinCliq may suspend, restrict, or forfeit FinCliq Balance in cases of fraud, misuse, account termination, or as required by law. FinCliq Balance has no cash value outside the Platform.


      20. FINCLIQ SAVINGS CIRCLES

      FinCliq Savings Circles are a voluntary community-based contribution feature designed to help users participate in structured contribution rotations.

      Savings Circles are not:

      • A savings account
      • A deposit account
      • An investment product
      • A trust or escrow account


      Key Terms:

      • Contributions are credited to FinCliq Balance and are not withdrawable.
      • Participation is voluntary and subject to platform rules, contribution schedules, and eligibility requirements.
      • Missed or failed contributions may affect rotation position, eligibility, or continued participation.
      • FinCliq does not guarantee rotation timing, contribution outcomes, or participation continuity.
      • FinCliq does not act as a bank, trustee, or investment adviser with respect to Savings Circles.


      21. GIFT CARDS AND STORED-VALUE PRODUCTS

      FinCliq may offer digital gift cards and stored-value products issued by third-party brands.

      Gift Card Terms:

      • Gift cards are issued and honored by third-party merchants or program managers, not FinCliq.
      • FinCliq acts solely as a distributor or reseller.
      • Gift cards are non-refundable once delivered, except as required by law.
      • Replacement of lost or stolen gift cards is subject to the issuer’s policies.


      Network-branded gift cards (e.g., Visa or Mastercard) are subject to the issuer’s terms and applicable network rules


      22. FINCLIQ+ MEMBERSHIP

      FinCliq may offer a subscription or membership tier (“FinCliq+”) that provides enhanced platform features, discounts, or eligibility benefits.

      FinCliq+ Disclosures:

      • Membership benefits may include reduced fees, expanded plan options, or promotional features.
      • FinCliq+ does not guarantee approval, credit increases, or eligibility for any specific service.
      • Membership benefits may change, be suspended, or discontinued at any time.
      • Billing frequency, pricing, and cancellation terms will be disclosed at enrollment.
      • You may cancel FinCliq+ according to the instructions provided in your account.


      23. MODIFICATION AND AVAILABILITY OF SERVICES

      FinCliq may modify, suspend, or discontinue any Service, feature, or benefit at any time, including but not limited to payment plans, FinCliq Balance, Savings Circles, gift cards, or membership programs. Continued use of the Platform constitutes acceptance of such changes.
